Was clear at oral arg that the dispute in 303 Creative was hypothetical--not a case or controversy, as required by Art. 3. No dispute meant no actual facts to parse, leading the Court to muse about truly unhinged hypos. We discussed on @StrictScrutiny_ podcasts.apple.com/us/podcast/str…

Hope someone is keeping list of all schools issuing statements in response to SCOTUS ruling. While it depends on how they act on commitment, early signal they’ll strive to promote diversity after, and even in spite of, ruling will be welcomed by many audiences, incl. applicants.
