Important episode. Critical session of the Sixth Committee (Legal) at the UN next week will decide whether the crimes against humanity draft treaty will move to negotiations…

When the Rome Statute entered into force, much of the energy for establishing a CaH treaty died down — but in 2024, the #ICC still hasn’t filled this gap in international law. New episode drops tomorrow. @janethanderson @vdbergstephanie @PillaiPriy @leilasadat1

There’s a lot of buzz about announced plans by Australia, Canada, Germany & Netherlands to jointly sue #Afghanistan at the International Court of Justice (@CIJ_ICJ) for alleged violations of the Convention on the Elimination of All Forms of Discrimination Against Woman (#CEDAW).

Another indirectly/non injured Party application citing the Genocide Convention. It will be very interesting to see how the Court receives this application for adjudication and request for Provisional Measures

Where is @Gambia_MOJ? Reasonable to ask why #TheGambia has never returned to the #ICJ to seek new/modified provisional measures based on new facts, especially where violence by junta appears targeted at #Rohingya. There are also reasons to do so in terms of political visibility.

This is a violation of the provisional measures ordered by the ICJ. @David_Cameron must now convene a UNSC meeting. Once again the Myanmar military is enjoying impunity and the British government is watching instead of acting. No lessons learnt from 2017.

Navalny was fine yesterday. We should expect a full Magnitsky style cover-up from the Russian government in short order. I can almost predict the language they will use: “natural causes”, “no sign of violence” “unexpected death” etc

The last time Navalny was seen alive was during a court hearing yesterday, where he appeared from prison via video link. He looked fine – though that's itself a sign of how his gaunt look and deteriorating health in harsh prison conditions was normalized.

*Important state practice on universal jurisdiction: Ljubljana-Hague Convention open for signature today - ~35 states so far. Includes oblign to prosecute genocide, crimes against humanity and war crimes ‘where alleged offender is present in any territory under its jurisdiction’.

So pleased to write this backgrounder on the International Court of Justice with the great Mariano-Florentino Cuéllar, President of @CarnegieEndow "The International Court of Justice’s Balancing Act" carnegieendowment.org/2024/01/26/int…

Brilliant impression given by Alonso! Agreed with all points. Interesting that the Court also noted the ongoing interstate proceedings at the CERD and the CERD’s Early Warning and Urgent Procedure.

This is where I’ll be tweeting my impressions on the ICJ’s Order on South Africa v. Israel. I don’t expect to live tweet as much as share my thoughts and point out anything noteworthy. I am centralising this here for ease of access

Community interests litigation is definitely gaining momentum! a crucial development that marks the end of a year 'full' of proceedings on erga omnes (partes) obligations, with the ICJ dealing with an increasing number of new cases and applications for interventions re Art 63

🚨Breaking!! South Africa institutes proceedings against Israel at the @CIJ_ICJ for genocide in #Gaza asking for urgent provisional measures 👇

This will be the second instance of a “non-Injured” State Party bringing a claim under the compromissory clause echoing the current case of the Gambia v Myanmar at the ICJ on violations of genocide. The next developments will certainly bear watching…

All eyes on the ICJ now as South Africa brings a case against Israel claiming that it is committing genocide against the Palestinian people. Provisional measures are requested so this will move quickly.

Such exciting news!

The Maldives (represented by Amal Clooney and Philippa Webb) and six other states have filed declarations of intervention in support of The Gambia in the #ICJ case against Myanmar alleging genocide against the #Rohingya under the Genocide Convention: doughtystreet.co.uk/news/maldives-… (1/2)

.@UNRWA shelters in #Gaza and northern Gaza are no longer safe. This is unprecedented.   This war should be no exception, protection of civilians and civilian infrastructure, including United Nations buildings, applies to this conflict too. Wars have rules.
