It's an interesting case. The #copyright claim here isn't trivial, both because the images are not the same (most of the copying is of style) and because @tesla has a strong fair use defense. Maybe the false endorsement claim has more meat. A great exam question.

As expected, we got an amended (& improved) complaint in @X v. Bright Data. IMO, some of the arguments against preemption are weak. But not all. Interestingly, X argues it protects its users' privacy (when selling their data). That's powerful and might require a trial.
