'Truth Will Not Be Bullied': @America PAC's attorney Chris Gober blasts Philadelphia DA's challenge of $1 million program youtu.be/PJiP_aHAXs4?si… @elonmusk
Three weeks after losing their motion for an emergency injunction, Philadelphia District Attorney Larry Krasner and his attorneys just withdrew their civil lawsuit against @America PAC and @elonmusk Here's a link to the filing: drive.google.com/file/d/1RQGQ9n…
In 2012, our law firm represented @PeteHegseth in his U.S. Senate race, which admittedly seems like a century ago. He is a 20-year military veteran, a decorated combat veteran, a 2x recipient of the Bronze Star, and a graduate of Harvard and Princeton. #departmentofdefense
Current state of mind…
Krasner "has not fully and completely established a clear right to relief and that he is likely to prevail on the merits of either his violation of the State Lottery Law or the UTPCPL claims" (i.e., the deceptive trade practices claims). DENIED.
Judge Foglietta found that Krasner "failed to make a clear showing of deceptive conduct" by @america and Elon Musk.

Judge Foglietta found that Krasner "failed to establish that ANY of the three required elements to establish what constitutes a lottery in Pennsylvania were met." (emphasis added)

Conclusion of Law: "this Court found [Krasner] unlikely to succeed on the merits of their claims."

What a week! Been functioning on a steady diet of adrenaline and finally home after a whirlwind tour in Philadelphia and Palm Beach.
BREAKING: Elon Musk’s $1 million-a-day voter sweepstakes can continue through Tuesday’s presidential election, a Pennsylvania judge says. apnews.com/article/musk-m…
Total turnout after the first three days of Early Voting in Nevada: 🔴Republicans: 96,858 🔵Democrats: 88,983 🟡Others: 59,515 VOTE EARLY
If I had a nickel for every time someone confused me with Reed Hastings, I would be a billionaire.
“The intent is to promote the principles that made America great in the first place. So I wouldn't say that I'm MAGA, 'Make America Great Again,' I think America is great. I'm more MAG - 'Make America Greater.'” @elonmusk tells @jordanbpeterson why he created a super PAC to help…
Let’s say Kamala spends Biden’s remaining funds and the @fec deadlocks 3-3 on whether that was legal. Wouldn’t Alvin Bragg’s new legal standard allow a DA to charge her with falsification of business records for conspiring to promote a candidacy by unlawful means? @treytrainor
"President Biden’s disastrous debate performance last night has most Americans asking the same question: Can they replace Biden as the Democratic Party’s nominee in the November general election?" vantagevault.circle.so/c/articles/can…
Congrats to the Cooper & Kirk and @GoberGroup lawyers that worked on this case for @tedcruz I also want recognize Cabell Hobbs, the committee’s record-keeping and reporting expert, for doing the non-glamorous work behind the scenes and volunteering to be one deposed by the FEC.
The Supreme Court sides with Sen. Ted Cruz in his First Amendment challenge to a federal campaign-finance law that limits how and when candidates can recoup loans that they make to their own campaigns. The vote is 6-3 along ideological lines.
Best excerpt from the opinion: “The government’s rationale for the loan-repayment limit fits about as well as a pair of pandemic sweatpants. The First Amendment requires a better fit than that.”
Since “A spokesperson for the Mann campaign said that their application was self-certified as a ‘business’”, perhaps that spokesperson can confirm they’re going to pay income tax on the funds they raised since that’s what businesses (and not political orgs) are required to do.
.@ChrisKGober, a political law attorney, advised his clients to stay away from PPP loans. He said the CARES Act and Small Business Administration rules are very clear that funds can't be used for political activity.
