1/7 *Doctrine alert*! On the @ICLQ_jnl 📣 @dzehtsiarou and I examined how the European Court of Human Rights uses legal scholarship in its judgments. We analyzed all Grand Chamber judgments from 1998-2021. Here's what we found... 🧵
@niccoloridi and I wrote a paper on how the @ECHR_CEDH refers to scholarship. We published it with @ICLQ_jnl in open access. This is the first empirically based analysis of the Court's practice in this area. Comments and questions - welcome: doi.org/10.1017/S00205…
18 Sept NYT round-up phrasing 'Israel hid small amounts of explosives in the pagers, which were made in Taiwan, before they were imported into Lebanon, U.S. and other officials said'. Implicates Taiwan without speculation.
Taiwan’s Gold Apollo is going to “SUE ISRAEL”…🇮🇱🇹🇼 Founder Hsu Ching-Kuang told reporters his company did not make the pagers.. Gold Apollo is going to launch a billion dollar law suit against the Israeli Government after they admitted MOSSAD had planted explosives in the…
CNI is vulnerable, and doesn’t have the clearest classification in terms of escalatory frameworks (i.e. violation of sovereignty, self-defence, lawful and/or strategic response). Developments in #cyberlaw and #spacelaw are instructive, but practice across domains need analysis
A lot of people don't seem to realise that there is a lot Russia could deniablly do in Europe that would hurt shy of invading Poland or lobbing nukes at London. Critical National Infrastructure is vulnerable
As a person from a post-Soviet country, I could not but find the institutions of People’s Republic of China oddly familiar. For every major institution of the Communist Russia, I could find a direct equivalent in Communist China. With one major exception: China had no KGB

The ICC Prosecutor's response to the 64 (often irrelevant, tendentious or legally weird) amicus curiae briefs is pithy and on point regarding jurisdiction and the Oslo Accords. Thread. icc-cpi.int/court-record/i…

This is part of the UK’s multifaceted minilateral defence policy (which should be more holistic post DefRev25). Enhanced Carrier Strike Group deployment, the Global Combat Air Programme Treaty (18 Dec 23), +Aukus marks an opportunity for UK leadership in the Indo-Pacific contest
3. A strategic relationship that should matter to Britain. The CSG deployment is part of a wider engagement in the region, one that matters to the UK for 3 reasons: A. It shows that being in a crucial part of the world is not a missed opportunity to be in Europe.
🎙In the latest episode of #GlobalSecurityBriefing, we discuss how Labour will approach the balance between security, values, economic interests and environmental concerns and the difficult trade-offs inherent in dealing with China. Listen here: bit.ly/3Yg1evG
'While Britain has some highly regarded capabilities, it also has forces that are smaller than in other major European states. And, without additional funding, capability and readiness will likely fall further.' #MilitaryBalance analysis: go.iiss.org/4eVT4P3
This is what my mess of a thesis gets at, but framed from PIL understanding #alliancepolicy #alliancelaw
Or Britain should double down on its process of integration and interchangeability not just within NATO - but crucially within other minilateral constructs. From JEF to AUKUS. Investing into becoming the neuralgic centre of a complex geometry of military arrangements.
Former MI6 chief, Sir Alex Younger gives some Brexit truths. “Putin would’ve been absolutely delighted by our decision (to leave the EU) and so would Xi.” “Particularly since I've left office and I've travelled around Europe, I'm profoundly depressed. “Just nobody mentions the…

Seems like real-time revision of UN powers as per the UN Charter. What sources support that UNSC resolutions are non-binding if using “recommendatory” language? And in any case “calls upon” is a directive, not a suggestion.
On the question of binding/non-binding, this draft may be mixed, even by US terms: "Calls upon" & "urges" (OP1) are generally considered non-binding, even by those who have a different overall interpretation of "binding" than US. But "Rejects" in OP5 could be considered binding.
Practice, rule terraforming, and pushing for something far beyond ‘just war’
Israel and Hezbollah are playing with fire, literally. Southern Lebanon and northern Israel are burning and empty of their residents. What is happening is much more than tit-for-tat, it is the attempt by each side to impose new rules through military action. Israel has the edge…
These closing words are all the more relevant today:
Here is my effort to grapple with what has been happening in Gaza and what it means for international humanitarian law, in @ForeignAffairs foreignaffairs.com/ukraine/war-un…
🧵Listing government reactions to ICC prosecutor's application for arrest warrants against leaders of Israel and Hamas. Scored on a 1-10 scale from the highest to the lowest support for the ICC. Limited to European & Western govts.
